Shipping & Delivery

1. Aakashbhoomi delivers to all the major cities and towns within India. However, we advise you to use the ‘Check Pin code For Delivery’ option available on each product’s page and verify whether your delivery pin code is covered before proceeding to purchase an item.
2. Your shipping address, pin code will be verified with the database of Aakashbhoomi before you can proceed to pay for your purchase. In the event your order is not serviceable by our delivery partner or the area is not covered, we would request you to provide us with an alternate shipping address, which we expect to have on our delivery list. In case there is any dispute regarding the shipment of the product or services for the area not covered by Aakashbhoomi, Aakashbhoomi will not be responsible for the non-delivery of the product.
3. Free shipping is applicable if the total order value is ₹ 1500 or more. For individual items priced below ₹ 1500 you will see the note “Free shipping not applicable for this item” on the product page. However, once the total order value of your shopping cart is ₹ 1500 or more, shipping costs will be automatically waived off. You can verify this by viewing your Shopping Cart.
4. For Orders of value less than ₹ 1500, there will be an additional delivery fee of ₹ 100 per order.
5. In case you book multiple items in one order, Aakashbhoomi would endeavour to ship all Products together. However, this may not always be possible due to some product characteristics and/or logistics’ issues, and Aakashbhoomi will not be responsible for the same If you purchase multiple products in a single transaction, then all the Products would be dispatched to a single shipping address given by you. If you wish to ship Products to different addresses, then you are required to place separate orders based on the different delivery addresses.
6. Events beyond our reasonable control – Aakashbhoomi will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control/could not be reasonably foreseen by us.

Cancellations

Cancellation by Aakashbhoomi:
(a) There may be certain Orders that Aakashbhoomi is unable to accept and must cancel. Aakashbhoomi reserves the right, at Aakashbhoomi’s sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in your order being cancelled include, without limitation, non-availability of the product or quantities ordered by you, non-availability of the service, inaccuracies or error in pricing information, or problems identified by Aakashbhoomi credit and fraud avoidance department.
(b) Aakashbhoomi may also require additional verifications or information before accepting any order. Aakashbhoomi will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order.
(c) If your order is cancelled, the refund process will be initiated as per the Returns & Refunds Policy section below.
(d) Aakashbhoomi reserves the right to cancel any order that classifies as ‘Bulk Order’ as determined by Aakashbhoomi as per certain criteria. An order can be classified as ‘Bulk Order’ if it meets with the below mentioned criteria, which may not be exhaustive:
i. Products ordered are not for self-consumption but for commercial resale
ii. Multiple Orders placed for same product at the same address
iii. Bulk quantity of the same product ordered
iv. Invalid address given in order details
v. Any malpractice used to place the order

Returns & Refunds

1. In the event of receiving a damaged/defective product, which may have occurred during shipping, please send the images of broken product along with the packaging material to our email address.
2. The information/complaint regarding the damaged delivery needs to be registered within 48 hrs of the receipt of the product.
3. Upon receiving your request/complaint, Aakashbhoomi shall verify the authenticity and the nature of the complaint and if Aakashbhoomi is convinced that the complaint is genuine, Aakashbhoomi will initiate a replacement or a refund. However, in the event of frivolous and baseless complaints regarding the quality and content of the products, Aakashbhoomi reserves the right to take necessary legal actions against you and you will be solely liable for all costs incurred by Aakashbhoomi in this regard.
4. Before accepting shipment of any product, kindly ensure that the product’s packaging is not damaged or tampered. If you observe that the package is damaged or tampered, we request you to refuse to accept delivery and inform Aakashbhoomi at the earliest.
5. The return process of the product may be restricted by Aakashbhoomi, depending on the nature and category of the product. Refunds will be subject to the following:
   (a) Orders paid for online will be refunded within 5-21 working days through the online account or via cheque.(b) If the original payment method used by you to make the payment (credit/ debit card) is no longer valid, we’ll issue the refund through a demand draft. When we receive a payment failure notice from your bank, we will send you an e-mail asking you to call us. When you call us back, we will collect your name and the address where you want the demand draft to be sent, and proceed with the refund.

General Terms & Conditions

a) The domain name www.aakashbhoomifarms.com (hereinafter referred to as “Website”) is owned by M/S Aakashbhoomi, a proprietary firm incorporated under the Indian Proprietorship Act, 1908 with its registered office at M/S Aakashbhoomi, opp. BDM Juice factory, Village Tatehra,PO Oel, Tehsil Ghanari, District Una, Himachal Pradesh, India (hereinafter referred to as “Aakashbhoomi” or “aakashbhoomifarms.com”).

b) Use of the Website is offered to you conditioned on acceptance without modification of all the terms, conditions and notices contained in these Terms, as may be posted on the Website from time to time. Aakashbhoomi at its sole discretion reserves the right not to accept a User from registering on the Website without assigning any reason thereof.

2. User Account, Password, and Security:

You will receive a registration email upon completing the Website’s registration process. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Aakashbhoomi of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Aakashbhoomi cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 2.

Aakashbhoomi through the Web Site (all such services, collectively, the “Service”). One such service enables user to purchase merchandise  (collectively, “Products”). The Products can be purchased through the Website through various methods of payments offered. In addition, these terms and policies may be further supplemented by Product specific conditions, which may be displayed on the webpage of that Product.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colour and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. 11. Exactness Not Guaranteed:

Aakashbhoomi hereby disclaims any guarantees of exactness as to the finish and appearance of the final Product as ordered by the user. This is especially applicable to food items as they tend to lose colour with passage of time and it’s a natural process therefore, the Product pictures on Aakashbhoomi may not be identical to the Product that you receive.

12. Intellectual Property Rights:

a) Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Aakashbhoomi owns all Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the Website belonging to Aakashbhoomi without obtaining authorization from Aakashbhoomi.

16. Pricing:

Aakashbhoomi strives to provide you with the best prices possible on products you buy or avail of from the Website. However, Aakashbhoomi does not guarantee that the price will be the lowest in the city, region or geography. Prices and availability are subject to change without notice or any consequential liability to you.

While Aakashbhoomi strives to provide accurate products, services and pricing information, typographical and other error may occur. In the event that a product or service is listed at an incorrect price or with incorrect information due to an error in pricing or product or service information, Aakashbhoomi may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Aakashbhoomi will have the right to modify the price of the product or service and contact you for further instructions via e-mail address provided by you at the time of registration, or cancel the order and notify you of such cancellation. If Aakashbhoomi cancels the order after the payment has been processed, the said amount will be remitted to your account from which the payment was made as per the Cancellations, Returns & Refunds Policy.

Prices for products are described on our Website and are incorporated into these Terms by reference. All prices are in Indian rupees.

17. Shipping & Delivery:

Force Majeure: If performance of any service or obligation under these Terms of Use or other Agreement by Aakashbhoomi is, or other third parties in fulfilment of any purchase or sale transaction (for eg: logistics service provider, fulfilment centre, payment gateways etc.) are, prevented, restricted, delayed or interfered with by reason of labour disputes, strikes, acts of God, floods, lightning, severe weather, shortages of materials, rationing, utility or communication failures, earthquakes, war, revolution, acts of terrorism, civil commotion, acts of public enemies, bandh, blockade, embargo or any law, order, proclamation, regulation, ordinance, demand or requirement having legal effect of any government or any judicial authority or representative of any such government, or any other act whatsoever, whether similar or dissimilar to those referred to in this clause, which are beyond the reasonable control of Aakashbhoomi or its third parties performing such services as sub-contractor to Aakashbhoomi and could not have been prevented by reasonable precautions (each, a “Force Majeure Event”), then Aakashbhoomi shall be excused from such performance to the extent of and during the period of such Force Majeure Event. Aakashbhoomi shall exercise all reasonable commercial efforts to continue to perform its obligations hereunder.

18. Termination:

a)  Aakashbhoomi may suspend or terminate your use of the Website or any Service if it believes, in its sole and absolute discretion that you have breached, violated, abused, or unethically manipulated or exploited any term of these Terms or anyway otherwise acted unethically.

b) Notwithstanding Section 15.a above, these Terms will survive indefinitely unless and until Aakashbhoomi chooses to terminate them.

c)  If you or Aakashbhoomi terminates your use of the Website or any Service, Aakashbhoomi may delete any content or other materials relating to your use of the Service and Aakashbhoomi will have no liability to you or any third party for doing so.

d)  You shall be liable to pay for any Service or product that you have already ordered till the time of Termination by either party whatsoever.

19. Governing Law:

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Amb .

20. Severability:

If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.

21. Report Abuse:

As per these Terms, user are solely responsible for every material or content uploaded on to the Website. 22. Events beyond our reasonable control

Aakashbhoomi will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.
